This Acceptable Use Policy ("AUP") governs your use of the StallWise service ("Service") operated by Showsafe LLC ("Company," "we," "us"). This AUP is incorporated into and forms part of our Terms of Service.
By using the Service, you agree to comply with this AUP. Violation of this policy may result in suspension or termination of your account.
1. Intended Use
StallWise is designed exclusively for professional equestrian facility management. The Service should be used for managing horse records, client relationships, facility operations, events, health records, training, feeding programs, staff, inventory, and related financial and business operations.
2. Prohibited Activities
You agree NOT to use the Service to:
2.1 Illegal Activities
- Engage in any activity that violates applicable local, state, national, or international law or regulation.
- Store, transmit, or distribute content that is illegal or promotes illegal activities.
- Facilitate fraud, money laundering, or other financial crimes.
- Violate animal welfare laws or regulations.
- Evade taxes or facilitate tax evasion.
2.2 Harmful or Abusive Content
- Upload, store, or transmit content that is defamatory, libelous, threatening, harassing, or abusive.
- Store content depicting animal cruelty or abuse.
- Distribute hate speech or content that promotes discrimination based on race, ethnicity, gender, religion, sexual orientation, disability, or other protected characteristics.
- Upload pornographic, obscene, or sexually explicit material.
- Store content that exploits or endangers minors.
2.3 Security Violations
- Attempt to gain unauthorized access to the Service, other user accounts, or systems connected to the Service.
- Probe, scan, or test the vulnerability of the Service or any related system or network.
- Interfere with or disrupt the Service, servers, or networks connected to the Service.
- Deploy malware, viruses, worms, trojans, or other harmful code.
- Conduct denial-of-service attacks or similar attacks against the Service.
- Attempt to reverse engineer, decompile, or disassemble any portion of the Service.
- Bypass or attempt to bypass any security measures, authentication systems, or access restrictions.
2.4 Intellectual Property Violations
- Infringe upon the intellectual property rights of Showsafe LLC or any third party.
- Upload content for which you do not have the necessary rights or licenses.
- Remove, alter, or obscure any proprietary notices or labels on the Service.
- Copy, reproduce, or redistribute the Service or any part thereof without authorization.
2.5 Misuse of Service
- Use the Service for purposes other than equestrian facility management.
- Resell, sublicense, or redistribute access to the Service without authorization.
- Use automated scripts, bots, crawlers, or scrapers to access or extract data from the Service (except through our authorized API).
- Create multiple accounts to circumvent subscription limits, suspension, or termination.
- Impersonate another person or entity or misrepresent your affiliation.
- Use the Service to send unsolicited commercial messages (spam).
- Manipulate or falsify records (e.g., health records, competition results) in ways intended to deceive third parties.
2.6 Data-Related Violations
- Collect, harvest, or store personal information of other users without their consent.
- Share or disclose login credentials or API keys to unauthorized parties.
- Upload another person's personal or confidential information without authorization.
- Use data exported from the Service in violation of applicable privacy laws.
3. Content Guidelines
3.1 Your Responsibility
You are solely responsible for all data, text, files, images, and other content ("Content") that you upload, store, or transmit through the Service. You represent and warrant that:
- You have the right to upload and use all Content.
- Your Content does not violate any applicable law or third-party rights.
- Your Content is accurate and not misleading, particularly regarding health records, veterinary information, and competition records.
3.2 Content Standards
Content stored in the Service should be:
- Relevant to equestrian facility management and related business operations.
- Accurate and maintained in good faith.
- Compliant with applicable regulations (e.g., accurate health and veterinary records).
3.3 File Uploads
Uploaded files (photos, documents, attachments) must:
- Be relevant to facility operations (horse photos, documents, veterinary records, etc.).
- Not contain malware or executable code.
- Not exceed the size limits defined by your subscription plan.
- Comply with applicable copyright and intellectual property laws.
4. Resource Usage Limits
4.1 Subscription Limits
Each subscription tier includes specific limits on the number of horses, users, and other resources. You agree to operate within the limits of your subscription plan. Exceeding these limits may result in restricted functionality until you upgrade your plan or reduce usage.
4.2 API Usage
If you access the Service through our API, you must comply with the following limits:
- Rate Limits: API requests are subject to rate limits based on your subscription plan. Exceeding rate limits will result in temporary throttling (HTTP 429 responses).
- Batch Operations: Bulk data operations should be performed during off-peak hours when possible.
- Authentication: API access requires valid authentication tokens. Tokens must be kept secure and not shared.
4.3 Storage Limits
File storage is subject to limits based on your subscription plan:
- Starter: 5 GB file storage
- Professional: 25 GB file storage
- Enterprise: 100 GB file storage (additional storage available upon request)
4.4 Fair Use
All usage is subject to a fair use standard. We reserve the right to throttle or restrict access if usage patterns indicate abuse, such as:
- Excessive API calls that strain system resources.
- Using the Service as a general-purpose file storage or database service.
- Automated processes that generate unreasonable server load.
5. Enforcement
5.1 Reporting Violations
If you become aware of a violation of this AUP, please report it to [email protected]. Include as much detail as possible, including the nature of the violation and any supporting evidence.
5.2 Investigation
We reserve the right to investigate suspected violations of this AUP. During an investigation, we may:
- Review your account activity and stored content.
- Temporarily suspend your access to the Service.
- Cooperate with law enforcement or regulatory authorities as required.
5.3 Enforcement Actions
If we determine that you have violated this AUP, we may take one or more of the following actions at our sole discretion:
Warning: For minor or first-time violations, we may issue a written warning and require corrective action within a specified timeframe.
- Content Removal: We may remove or disable access to Content that violates this AUP.
- Feature Restriction: We may restrict specific features or capabilities of your account.
- Temporary Suspension: We may temporarily suspend your account for a period commensurate with the severity of the violation.
- Permanent Termination: For severe or repeated violations, we may permanently terminate your account.
- Legal Action: We reserve the right to pursue legal remedies for violations that cause harm to us, our users, or third parties.
Immediate Termination: We reserve the right to immediately terminate accounts without prior warning for severe violations, including but not limited to: illegal activities, distribution of malware, security breaches, content depicting animal cruelty, or content that exploits minors.
5.4 Appeals
If you believe an enforcement action was taken in error, you may submit an appeal by emailing [email protected] within 14 days of the action. Your appeal should include:
- Your account information.
- A description of the enforcement action.
- The reason you believe the action was incorrect.
- Any supporting evidence.
We will review your appeal and respond within 14 business days.
6. Changes to This Policy
We may update this AUP from time to time. We will notify you of material changes via email or through the Service at least 15 days before the changes take effect. Your continued use of the Service after changes take effect constitutes acceptance of the updated AUP.
